These Terms of Use set out the conditions for using the AventureBox system and our services. The AventureBox platform, owned by the company AventureBox Serviços de Informação na Internet Ltda - ME, CNPJ: 22.045.102 / 0001-66 (Brazil), provides access to various content and information services on internet (hereinafter "services"). The AventureBox is a multiplatform system developed to cultivate the outdoor lifestyle in a sustainable and inclusive way. We constantly develop technologies so that practitioners of activities in nature can: explore and find information about new destinations, create a network of followers and record their adventures and posts. We also offer services so that companies and organizations from the outdoor segment can efficiently bring their products and services closer to their consumers.

Acceptance of the Terms of Use

By registering or using AventureBox, you agree to the Terms of Use (hereinafter, "Terms"). These Terms govern your access to and use of our services, including your rights and obligations. If you do not agree with the terms of this document, please do not use AventureBox services.

If you are accepting these Terms and using our Services on behalf of a company, brand, organization, government or other legal entity, you represent and warrant that you are authorized and empowered to perform these actions and to bind that entity to these Terms. In this case, the words "your", "you", or similar used in this Terms will refer to that entity.

Basic Terms

You are solely responsible for any activity that occurs through your registration and you agree not to transfer, sell or assign your registration, your username or any registration rights.

You are solely responsible for your conduct and for any photos, images, graphics, data, text, user names, files, information, profile, audio, video, someone else's work, applications, links and other content or materials (collectively, "Content") that you upload, post or display on or through AventureBox.

You may not use AventureBox for any illegal or unauthorized purpose.

You agree that you will not create a registration for anyone other than yourself. You also declare that all information provided by you or provided to AventureBox at the time of registration and at any other time is true, accurate and current. You agree to update your information when necessary to maintain its accuracy.

It is prohibited to publish content or take any action on the AventureBox that infringes or violates the rights of others.

It is prohibited to publish content that suggests violence, nudity, partial nudity, discrimination, illegal acts, transgressions, hatred, pornography or sex, through the Services.

You will not collect content or information from users, or access the AventureBox in any other way, using automatic means such as: collection bots; robots; or spiders without written authorization from AventureBox.

You cannot publish confidential or private information through the system.

You are responsible for keeping your password confidential and protected.

You agree that there is no partnership, employment relationship, joint venture or commercial representation between you and AventureBox due to the use of this system.

You cannot abuse, threaten, defame, stalk, bully, harass, pretend to be people or entities.

You agree to obey all laws, rules and regulations: federal; state; and municipal, applicable to your use of the system and its content, including, among other things, copyright laws.

You may not post any form of harassment, also known as "spam," on AventureBox or another user.

You will not do anything that could overload, disable, interfere, interrupt or prevent the proper operation of the AventureBox, including anything that affects the service, servers or networks connected to the service.

You cannot use AventureBox to transmit worms, viruses, spyware, malware or any other code of a destructive nature.

You cannot create an AventureBox account through unauthorized system.

The content you submit, publish or make available may be viewed by other registered users, or visitors to the system, or through third party services and websites. You should only make available on AventureBox, content that you are comfortable sharing with others publicly.

Conditions

You must be at least 18 years of age or the legal age of majority in your country to use our Services.

You can disable your AventureBox account in the "Settings> Configure Account" menu, in which case your profile and content will no longer be publicly available on the platform, however, we inform you that we will keep your data confidential, in a controlled and secure environment , for a period of 30 days. In this period you can still recover your AventureBox account, in case it was deactivated by mistake or incorrectly.

In case of violation of these terms or judicial notice to remove the content, AventureBox, undertakes to communicate the reasons and information regarding the unavailability of content, with information that allows the adversary and the wide defense in court, unless expressly provided by law or express judicial determination based on the contrary.

We reserve the right to deprive any username for any reason we deem necessary to better offer our Services.

You must not use usernames or page names in the AventureBox of other institutions, public figures, companies and brands that you do not have copyright or permission. AventureBox reserves the right to change your username if this term is breached at any time.

You are the owner of your Content and will retain your rights to any Content you upload, post or display on the AventureBox.

By submitting, publishing or displaying any Content on AventureBox, you grant us a free worldwide license, with the right to sublicense, to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute this Content on any and all types of media or distribution channels available or to be developed. This license authorizes us to make your Content available to the rest of the world. You agree that this license gives AventureBox the right to provide, promote and improve the Services, in addition to making Content submitted through the Services available to other companies, organizations or persons who are partners of AventureBox for the purposes of distribution, sharing, transmission , disclosure or publication of it in other types of media and services, subject to our Terms and conditions of use of Content.

You represent and warrant that you have obtained or have all the rights, consents, permissions, licenses, powers and / or authorizations necessary to grant the rights mentioned here for any Content sent, posted or displayed by you on the AventureBox. You agree that the Content will not contain materials protected by copyright or other exclusive rights unless you have the necessary permission or are otherwise legally authorized to post the material and grant AventureBox the license described above.

In consideration of AventureBox for granting you access and use of the Services, you agree that AventureBox and its partners may place advertisements on the Services and also in connection with the display of Content or information, sent by you or by others, without any remuneration. Since your use of the Services is agreed to as sufficient compensation for the Content and the granting of rights contained herein.

Modification of Terms of Use

The AventureBox reserves the right, in its sole discretion, to modify or replace any of these Terms of use. We may notify through messages on the system or by e-mail when there are changes in the Terms of Use, but it is your obligation to check whether there were changes in this document since its last access to the system. Your continued use of the system following the posting of any changes to these Terms of use constitutes acceptance of these changes.

Limitations, changes and discontinuity system

AventureBox reserves the right to change, suspend or discontinue the system at any time should we deem it necessary. We will endeavor to notify you in advance, through a notice in the system or through the registration email.

Warranty Disclaimer and Limitation of Liability

For purely technical and operational issues, the AventureBox can not guarantee the availability and continuity of the system and its services. On that occasion, the system will warn in advance as interruptions to the operation of the service, but you can never guarantee that use of the system and its services will be uninterrupted, timely, secure and error-free and that any defect in the service or on the system will be corrected.

AventureBox is exempt from the responsibility for all damages, losses and expenses of any kind (including legal costs) if there is any complaint regarding their actions or content AventureBox.

We offer our services so that all our users can share their content about outdoor activities but we are not responsible for the conduct of any user.

Try to keep it updated AventureBox, error-free and safe, but you use at your own risk. Provide AventureBox “as-is”, without express or implied warranties, including merchantability.

In AventureBox may contain links to third party websites provided by users, which are not under the control of AventureBox. For this reason, we are not responsible for the content of any site mentioned in AventureBox.

By publishing Content on the platform you agree and authorize AventureBox to publish your publications on the official AventureBox profiles on other social networks such as Facebook, Instagram, Twitter, Tumblr and Pinterest, always referencing your profile. At any time you can request the removal of the disclosure for any reason through the message system of the referred social network or through direct contact by email@aventurebox.com

It also authorized the integration of AventureBox next to your Facebook® account, so you agree that the system will have access to basic profile information and friends list. Here`s how it held the data sharing policy by Facebook® https://www.facebook.com/about/privacy/your-info-on-other.

Legal Removal Requests

The AventureBox respects the rights of others. If you have any complaint or objection to the content posted by another user, or believe that the content published on AventureBox infringes their intellectual property rights, please contact you immediately in through copyright@aventurebox.com email, providing your full name, identity card, user name (if registered) and all possible evidence to prove their ownership of the content. Upon receipt of your complaint, we will check the evidence and put our efforts to remove illegal content within a reasonable period of time.

The AventureBox will make all efforts to remove content generated by third parties containing violation of privacy resulting from disclosure, without permission of the participants, pictures, videos or other materials containing nudity or sexual acts of a private nature when, after receipt of notification by the participant or his legal representative. The notification must contain under penalty of nullity, information required for the specific identification of the material appointed as a member of the intimacy of the rapist and verifying the legitimacy of the request.

Controlling Law and Jurisdiction

These Terms of Use are governed by Brazilian law and any disputes arising out of these Terms of Use shall be processed in the jurisdiction of the city of São Paulo.

Waiver and Severability

The event that any provision of these Terms is held to be invalid or unenforceable, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.

Language

The language of the original version of this service term is Portuguese (Brazil). In case of conflict of any translated version of this document, according to the original version, the latter one will prevail.
